Waiver, Release, and Assumption of Risk Agreement

This Waiver, Release, and Assumption of Risk (“Agreement”) is required for participation in any Florida Redfish Series (“FRS”) event, which includes tournaments, weigh-ins, socials, and captain’s meetings (“Tournament”). In exchange for the benefits of participation and other valuable consideration, the undersigned, for themselves and on behalf of their team members—including any minors referred to as the “Team”—agrees to the following terms and conditions.

To allow the Team or angler to participate in any Tournament, the undersigned permanently waives all rights for themselves and their Team against any injuries, including death, that may occur as a result of participation in the Tournament. The Team hereby fully releases and discharges the FRS, its directors, officers, members, representatives, sponsors (including featured sponsors), and any other associated or participating individuals or entities (“Released Parties”) from all liabilities, claims, demands, suits, causes of action, expenses, and costs (“Claims”) that may arise in the future for injuries, damages, or losses (“Damages”).

The undersigned agrees to indemnify and hold harmless the Released Parties, including their families, spouses, and employers, from all Claims, including attorney's fees, that may result from any act, omission, or negligence related to the planning or operation of the Tournament or the Team’s participation. Additionally, indemnification covers any Claims arising from the Team’s failure to comply with this Agreement or breach of the Warranty described below.

Under no circumstances will the FRS be liable for any special, incidental, indirect, direct, consequential, or punitive damages, regardless of the nature of the action—whether contract, tort (including negligence), statute, or otherwise—even if the FRS has been informed of the possibility of such damages.

The undersigned warrants and represents that the Team or anglers will comply with all applicable federal, state, and local laws and regulations at all times during the Tournament, including during travel to and from events. This includes fishing regulations and size limits, as well as rules governing the operation of motor vehicles (both automobiles and vessels). The Team will act with integrity and avoid any conduct that could negatively reflect on the FRS or its sponsors.

This Agreement is governed by and will be interpreted in accordance with the laws of the State of Florida. All disputes or matters arising under or related to this Agreement must be litigated exclusively in a court located in Leon County, Florida.

The Agreement is intended to be as broad and inclusive as permitted by Florida law. If any portion of the Agreement is found invalid, the interpreter shall replace the invalid provision with similar language that favors the FRS as much as allowable under applicable law. The remainder of the Agreement will remain in full legal force and effect.

The undersigned affirms they are at least 18 years of age and have authority to act on behalf of their Team and any guest they bring or invite to the Tournament. They acknowledge and agree that participation in the Tournament is a voluntary recreational activity and accept all risks, known and unknown, of damages resulting from their Team’s participation. The undersigned confirms that they have read and understood the legal consequences of signing this Agreement, that no oral representations have been made to induce signing, and that the Agreement is being signed freely and voluntarily. It is intended as a complete and unconditional release of all liability to the greatest extent permitted by law.
